1. Acceptance of Terms
By accessing or using the American Progressive Telugu Association ("APTA") website at https://ap-ta.org and any related services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and APTA.
2. Membership
Membership in APTA is subject to the terms set forth in our Bylaws and membership policies. By registering for membership, you agree to: (a) Provide accurate, current, and complete information during registration; (b) Maintain and promptly update your membership information; (c) Maintain the security and confidentiality of your account credentials; (d) Accept responsibility for all activities that occur under your account; (e) Comply with all applicable APTA policies, bylaws, and codes of conduct. APTA reserves the right to suspend or terminate membership for violation of these terms or conduct detrimental to the organization, as outlined in the Bylaws.
3. Donations & Tax Deductibility
APTA is a registered 501(c)(3) non-profit organization. All donations made to APTA are tax-deductible to the extent permitted by law. Donation receipts will be provided for your tax records. Donations are processed through our secure third-party payment platform (Zeffy) and are subject to their terms of service. Unless otherwise specified, donations are non-refundable. APTA reserves the right to allocate donated funds to programs and initiatives that best serve the organization's mission, unless the donation is specifically designated for a particular program. 4. Website Use
You agree to use the APTA website only for lawful purposes and in a manner consistent with these terms. You may not: (a) Use the website in any way that violates applicable federal, state, or local laws; (b) Attempt to gain unauthorized access to any portion of the website, other accounts, or computer systems; (c) Use the website to transmit any harmful, offensive, or objectionable content; (d) Use automated scripts, bots, or scrapers to access the website or collect data without express written permission; (e) Interfere with or disrupt the operation of the website or servers; (f) Impersonate any person or entity, or misrepresent your affiliation with any person or entity; (g) Use the job board, matrimonial, or community services for any fraudulent or misleading purpose.
5. User Content
By submitting content to the APTA website — including but not limited to job postings, matrimonial profiles, forum posts, event photos, testimonials, and scholarship applications — you grant APTA a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute such content in connection with APTA's operations and mission. You represent and warrant that you own or have the necessary rights to submit such content and that it does not infringe upon the rights of any third party. APTA reserves the right to remove any user content that violates these terms or is deemed inappropriate, without prior notice.
6. Intellectual Property
All content on the APTA website, including but not limited to text, graphics, logos, images, audio, video, software, and the overall design and layout, is the property of APTA or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws. The APTA name, logo, and all related marks are trademarks of APTA. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the website without the prior written consent of APTA.
7. Limitation of Liability
The APTA website and all content and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. APTA does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, APTA, its officers, directors, employees, volunteers, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or services, including but not limited to damages for loss of data, profits, or goodwill. APTA does not endorse or guarantee the accuracy of job postings, matrimonial profiles, or other user-submitted content.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the state or federal courts located in Sedgwick County, Kansas. By using the APTA website, you consent to the personal jurisdiction of such courts and waive any objection to the convenience of such forum.
9. Changes to Terms
APTA reserves the right to modify, update, or replace these Terms and Conditions at any time at its sole discretion. Material changes will be communicated to members via email and posted on the website with a revised "Last Updated" date. Your continued use of the website and services after any modifications constitutes your acceptance of the updated terms. We encourage you to review these terms periodically. If you do not agree to the modified terms, you should discontinue use of the website and contact us to cancel your membership if applicable.
